These top people through their published code of Business Practice preach fairness and compassion but in reality they are guilty of huge failings of corporate governance and throughout they would seek to cover up rather than seek out the wrongdoing and discipline the perpetrators. These very top people live in willful ignorance about what is going on which clearly raises the question of competence for these very top people. But I did not kick a DISABLED DRIVER off site at UPS Shaw cross. I did not give false information at a disciplinary hearing to have an employee dismissed I did not tell deliberate lies and give false information to an Industrial Tribunal to try and pervert the course of Justice. I did not give false information to his legal team, to try and get my web site closed down. I am not employed by UPS; however, I work through a driving agency on contracts driving Articulated lorries. Today I was contracted to work for UPS for a full week tramping around the country. However, I was ejected from our local site before I could even leave the yard. Now you may think I did something seriously wrong to incur the wrath of the transport Manager to have such a thing happen, such as dangerous driving, foul mouth, endangering the lives of others on site but alas this was not the case, my crime...being disabled! yes that is right, being disabled. I suffer with degenerative joint disease, have recently undergone a shoulder replacement op, have to wear a leg brace and walk with the support of a walking stick yet I have worked hard to keep working, however as a Mr. Paul Sellers states, 'he does not want people like me on site'. it does not matter that our DVLA have passed me fit to drive, I have been reassessed many times and all other contracts I work on do not have any problems with me, my disability or my attitude towards work yet UPS look on people like me as a blight. As my agency knows, I will do/attempt any job, if I find that work a little too hard, I will complete my contract, whether it be 1, 2,3 6 days but I will and never have walked off a job. Yet UPS did not even give me the opportunity. In fact, this guy did not even approach me first, he contacted my agency manager and told her he wanted me off site before he even approached me. This company is nothing but the lowest of the low and I am still waiting for their HR and management team to get back to me. Instead he went straight to the agency and told them he wanted me off site. As mentioned in my post, I am registered disabled, and have difficulty walking great distances hence my walking stick and leg brace. However, after my shoulder op, I was re-assessed medically and physically by the DVLA who passed me fit to drive, I have done work for Asda, next, M&S, Bedford's, Wicks, and Flymo (Wincanton) loading and unloading pallets sometimes double deck trailers at 56 pallets a t a time. Although this may take me a little longer than most able bodied people I get the job done without complaining and all these companies ask for me back which goes a long way in proving my abilities, yet this guy did not even ask me anything other than telling me he wanted me off site 21st February 2012 DSA has not looked at UPS Shaw Cross yet but URTU is only getting what it deserves at last and a long time coming a pitty they are out on bail The United Road Transport Union (URTU) has become the first organisation to have its Driver CPC training approval withdrawn, following an investigation by the Driving Standards Agency (DSA). As revealed in Commercial Motor's sister title Motor Transport (19 September), the investigation was launched after two formal complaints about a health and safety course run by the URTU at the Holiday Inn, Bristol, on 4 September. The course was attended by 31 drivers paying £20 a head, including lunch. CM understands that the complaints allege that although the course started at 9am, ended at 2.15pm and included two 40-minute breaks, it was logged as seven hours’ training. For a full-day course to count towards the Driver CPC, it must include at least seven hours’ training accredited by approval body the Joint Approvals Unit for Periodic Training (JAUPT). It is also understood that the complaints relate to the quality of training and the number of drivers on the course. The DSA says in a statement: "We take any complaint extremely seriously and are committed to ensuring that all Driver CPC training courses – and providers – meet the high standards required of them. Training providers that are found not to meet these high standards may have their approval suspended or withdrawn. "URTU has failed to meet its obligations as an approved training provider and so its approval to deliver Driver CPC periodic training has been withdrawn." In response, a statement from the union says: "URTU is surprised to learn that the DSA have informed the press of its decision to withdraw approval for the union to deliver its Driver CPC course Health and Safety at Work Law. "URTU ;;;;;;;;;;;;;;;;;understands that there is a statutory appeals procedure that deals with such decisions taken by the DSA. It would be wholly inappropriate and unfair on the DSA if the Union were to make any further comment until there had been a completion of the due processes of law." URTU, which received written notification of the DSA’s decision last Friday (2 December) has 28 days to appeal the decision, which if challenged would go to a first-tier tribunal. The news will do nothing for the reputation of the already unpopular Driver CPC. A recent Freight Transport Association survey suggested uptake remained low, with up to 46% of UK operators set to miss the 2014 deadline. Quality of provision was a key concern. (1) Initially send your letters by email (2) Send copies at same time to Human Resources (at least three separate email address’s) (3) Send copies to complianceline@complianceconcepts.com (4) Then send copies by overland mail (5) Make sure that all the above is done by cc, or forwarded email. This way every one gets the original emails unedited This way UPS will not be able to deny that you responded on time and many people will be informed about the problem, much more difficult for UPS to cover up the problem. I am going to dedicate all my spare time to providing members of the public with copies of all correspondence that has gone on between myself and UPS and this will include all your major accounts like Micron, Trespass, Apple and a whole lot more, your customers will no doubt think to themselves that if you can do this to someone who does not even work for the company what will you do to other people and from the people I have already spoken to have their own opinions of UPS and they are not very nice to say the least. If you had checked the paperwork correctly you would have noticed that the payment my husband made was to a totally different email address so therefore you have no reason to be in possession of any documentation regarding myself and my children. A copy has also been sent to you in the post. RgdsEmma Date 10th October, 2011 Dear Mrs Hastie I am Nigel Goodson, Human Resources Manager, Europe Region, and have been passed your complaints and concerns contained in your email dated 29th September, 2011 to Emma O'Toole, Workforce Planning Manager. We of course take any concerns and complaints raised seriously, and I have now investigated the points which you have raised. I should say at the outset that some of the comments you have made relate to matters confidential to either your husband or other employees, and as such I am not able to provide details regarding these matters. However, I am confident that I have been able to address the key points contained in your email, and hope that this letter gives you the assurances which you require. A Background 1 As you have said in your email, Paul (your husband), was suspended on 26 September 2011 in relation to an investigation into the use of his American Express card. 2 This investigation involved looking into where payments had been made by Paul’s credit card, and the billing invoice for the card showed a payment to a paypal account named Ebone30. B. The Investigation and the Picture of your Children, Forum Discussion 1 An investigation took place, run by Paul Mooney, into the payments which had been made on the card. This included a google search being undertaken for the Ebone30 paypal account to try and determine where the payment had gone. 2 The google search was for “PayPal ebone30”, and 3 results showed, one of which was a wedding planning discussion forum called hitched.co.uk. On checking the discussion thread on the wedding forum, there were mentions of payments to a paypal account and email called ebone30@hotmail.co.uk. I understand that Paul Mooney then clicked on the person who had made the comments relating to the email ebone30@hotmail.com, and it showed that the person’s name was Beth, she was living in Lanarkshire and she was a freelance florist. The person who owned the account had a picture of 2 children as their profile picture. 3 Paul Mooney believed that this was you (Paul’s wife), and therefore that this was relevant evidence in terms of showing what Paul had used his credit card for. 4 Paul printed one copy of the profile (which included the picture of the 2 children), and one copy of the discussion thread. This copy was provided to your husband as part of the investigation. C. Your Complaints and Concerns 1. Paul Mooney clearly believed it was appropriate to investigate where payments had gone from your husband’s corporate credit card. In investigating this, Paul Mooney used google and provided a copy of evidence which was relevant to a payment being made to Paul’s wife (yourself). I do not believe that this was inappropriate. There is nothing to suggest that you were or are under investigation, and I have found that that is clearly not the case. This documentation was only produced in connection with the investigation concerning your husband. 2. I appreciate that you are upset that the investigatory materials contained a picture of your children, and a forum conversation. However, these have only been provided to your husband and were taken from publicly available sources following a google search. I can confirm that these documents have not been provided to anyone not involved in either the investigation in relation to your husband, or the investigation in relation to the concerns you have raised, and I have instructed that any copies of these two documents are deleted / destroyed, aside from one copy which will remain in the locked HR cabinet at the UPS centre (which can only be accessed by UPS HR) in case it is needed for the process in relation to your husband. I am not able to comment in relation to the points that you have raised regarding the reasons for your husband's suspension, or the claims which your husband has against the Company. These are obviously points which your husband will be able to raise directly with the Company, and it would be inappropriate for me to discuss or consider these confidential issues directly with you. It would also be inappropriate for me to discuss any points that you have raised in relation to other employees of the Company. However, I can assure you that the Company takes any complaints made seriously and appropriate investigation will be undertaken in relation to any such complaints. I hope that this letter satisfies your complaints and concerns. If you have any further questions, please send these to Nigel Goodson at nigel.goodson@europe.ups.com. My husband works for UPS at the Glasgow depot on Monday morning he was called into the office by Paul Mooney regarding his American Express card, after that meeting Paul Mooney suspended him on full pay he didn’t give him a reason for the suspension he just said that due to what we have spoken about today I need to suspend you until we carry out investigation, when Paul arrived home he phone Beth Craddock in HR to ask for the minutes of that meeting and the letter. Later that day my husband received that email with a comment saying further documentation to follow, the following day he received another email from Beth Craddock with documents attached and to my horror when he opened it….. there is a picture of my kids and a private personal chat I had with a member of a forum I used to use dated 1st April 2008 at 17:53.Now first thing why has Paul Mooney or any other member of your organisation have a detailed picture of my kids, when I phone Mr Mooney for him to explain his actions all I got from him was an extremely cocky attitude from him saying that it was relevant to the investigation I am sorry but why is this relevant to my husband because at that time he was my boyfriend and stayed at his mother’s house in Greenock and also never had a American Express card at that time with your company now in the meeting Paul Mooney mentioned fraud twice but in the letter my husband got its says misuse of card for personal use. So I want to know why Mr Mooney or any other UPS management investigated me? I do not work UPS and certainly neither does my kids. What gives him the right to be in POSSESSION of a picture of my kids as I certainly did not give him permission and how many copies of this picture are floating around UPS either on paper or worse on company laptops or desktop computers? Secondly the conversation that came with email regarding myself and a fellow member of a forum (SEE ATTACMENT) according to Mr Mooney this is relevant, tell me where a conversation clearly dated 1st April 2008 were I am having a private chat and when I say private I mean no other members can see this conversations regarding myself talking about jewellery I wanted to buy for I wedding I was attending in May 2008 and also tell me where on that conversation does it say that Paul Hastie was my partner, this has no relevance what so ever to do with UPS nor my husband’s suspension. Paul Mooney has pushed the boundaries too far and I think that what he has done must have broken your own organisations CODE OF POLICY & PROCEDURE (‘the code’) and maybe data protection act or even a blatant breech of my children’s right to privacy along with my right to privacy, I feel violated and physically sick that Mr Mooney and UPS have a picture of my kids, how do I know Paul Mooney has not and will not distribute that picture to vile members of the public? or will not fall into the wrong hands i.e. remember the laptop that went missing or stolen with employee’s personal data on it. Like I said I feel violated and physically sick this should never have been allowed to happen and I am now wondering what other parts of my personal life and my kid’s life’s UPS have spied on. I hope these strong and very serious issues will be taken seriously by the company that my husband has dedicated 17 years of his adult life to and that you will consider suspending Paul Mooney until this investigation is being carried out, after all it’s a very serious matter and one that I am obtaining legal advice through my husband’s Unite the Union membership, this whole witch hunt yes that’s right witch hunt is not only sole destroying but devastating to my family as my two kids as this has been very stressful for them because they see their parents so upset and asking questions to why dad’s work has photo of them. When I talk about witch hunt I mean this all started off as a personal one against my husband because he has stood up to the BULLIES in UPS and when the bully boy tactics failed they have now involved the rest of my family. Paul Mooney, Brian Begbie and no doubt a few others in the UPS organisation are determined to get my husband out as he has two on going claims, one is for accident which UPS has offered to settle on and because he has refused to settle the big men at the top are saying how dare he bite the hand that feeds him, the other is tribunal for lead driver which Roger Mayes has still not giving the answer to since the 24th of May this year now correct me if I am wrong should this not have been dealt with a lot sooner according to your company policy. Like I said they are determined to push my husband out of a company he has been very loyal to and miss family weekends to work for UPS and they will do it by any means weather it’s with pushing Paul that he says I have had enough and walks or going to do it by whatever means possible to sack Paul but they have over stepped the mark when they have involved kids an myself in their stupid games, I expect this to be dealt with properly and quickly and if they think I’m going to sit back and do nothing then they can think again. You obviously have not done a very thorough investigation and to be honest I’m not surprised but if you had you would be aware of the fact that Paul Mooney HAS broken quite a few data protection issues and you don’t have to take my word for it. Before I contacted you lot regarding this I had sought legal advice and know where I stand regarding this but as usual you lot have just completely dismissed this as no doubt just another trivial matter. This morning I have lodged a complaint with the information commissioner who is now going to be investigating this serious matter as what you have done to me and my children has no relevance to my husband’s suspension what so ever and if you had looked at the documentation properly you would have noticed this and therefore you have breached several laws by doing this and also the information that you have about me and my children has been passed from Paul Mooney to Beth Craddock who has looked at the information as she emailed it to my husband and also told my husband that she had seen it and was mortified at what the company were doing to him and god knows who else yet again that’s another breech. Please do not insult my intelligence by telling me that it’s only Paul Mooney who as looked at this information because I have evidence that other people have been in possession of it. UPS FORCES SUBCONTRACTOR OUT OF BUISINESS BY DUBIOUSE MEANS On 5 April 2011 10:38, Geoff Hallam Hi Dave Just been reading your web page with great interest and am glad to see that someone is prepared to take on the all so mighty and all so corrupt UPS. I have fallen foul of UPS myself in the last 3 years, when I foolishly got into bed with them as a contractor in their package distribution division in Leeds. I was originally an owner driver for Lynx Express when it was purchased by UPS in 2006. It became apparent that it was their intention to get rid of all owner drivers and replace them with Outside service providers. These were to be Limited companies only with their own employees. This meant that they could still service areas at a greatly reduced cost and it would also negate them from any responsibility with HMRC over whether or not owner drivers should be employed or not, as this was a grey area. Myself and another owner driver decided to join forces and tendered for one of the areas in January 2008. We felt compelled to do this as if we had not we would have had no business as they were terminating owner drivers. From the outset it became clear that all was not above board (shall we say) as we appeared to be being groomed to win the tender. How do I know this you might ask? Well after the tender was submitted we were contacted and told what our rates should be and we did indeed win the contract. This constituted a coercive tendering process and I feel quite sure that if all parties who tendered new this they would be non-too pleased and may in fact have a legal case against UPS. Included within the tender was details on how many vehicles and staff we would provide to service the contract. After we had started to service the contract in April 2008 they then started to demand that we provide staff to cover and assist with evening shifts etc. This was not part of the original tender but they made it quite clear that they expected us to provide these people. Apparently if you speak to any company who does contract work for UPS this is the norm they want to pay for a bronze service and get a gold service. They had also massaged the figures in the RFQ, which was used to formulate the tender, and this meant that we were down approx.. 20% on revenue. We argued that as they had supplied the figures they had a responsibility to make good the contract. You’ll no doubt not be surprised when I tell you that they declined. We fought on for the first year at great expense to both myself and my business partner. This ultimately led to myself losing everything! Then in May 2009 a new customer moved onto our patch which was to be the saviour of our business and safeguard everyone’s jobs. This was worth approx.. £180,000 a year to our business and when UPS figured this out they withdrew the work from us even though we had an exclusive territory rights contract. They felt aggrieved at having to pay us so much to service one customer. There are too many incidents of bad practice and bullying by management to include in this email, but it culminated in the company going into administration in January 2011. This was as a result of us issuing legal proceedings against UPS for material breach of the contract. They manoeuvred us into a position whereby we could not function and indeed Steven Lake of UPS contacted our funding lines which resulted in us having great difficulty in releasing funds. It was at this point we called time. During my time there I heard many tales of bad management and bullying of their own staff, again far too many to list, but as you say management have their pets and all cover each other arses by lying through their teath. There is also issues with drivers working too many hours whilst being on tacoghraps, although they would deny this, no surprises there. Employment Tribunal determines ‘Worst Case Ever of Improper Conduct’ at RCS Logistics, Corby In announcing its decision, on 7 March 2011, in favour of a driver who had made a claim of constructive dismissal against his former employer, RCS Logistics, the Chairman of the Leicester Tribunal summed up that, ‘over all the years that they have had to determine improper conduct by management, this had been the worst case ever’. Peter Cleaver, a 66 year old driver, had been employed by the Company, which is also known as Ray C Smith, for over 16 years and, for the last five years, he had also been one of four Driver Representatives. He attended a meeting, which included the Managing Director, another Director and a Senior HR Manager, to discuss a wage review for the drivers who, in the previous year, had been forced to accept a pay cut. As part of the discussions, Mr Cleaver sought to point out that the Directors had ‘done alright’ with new cars, new businesses and money in the bank, at which the Managing Director, Phil Mitchell, flew into a rage and threatened Mr Cleaver with violence, inviting him to go outside of the gate to ‘sort it out’. He also warned Mr Cleaver to watch himself in Stamford, where he lives, and where Mr. Mitchell and other Directors often drink in a local pub. Mr Cleaver was so concerned and shaken by this event that he informed the police of the threats made against him and did not return to work whilst his trade union, the United Road Transport Union, immediately sought to obtain assurances from the Chairman of the Company, Simon Smith, regarding Mr Cleaver’s future wellbeing at work. An invitation from the Company to simply get round the table to discuss the issue was considered. The Union contacted ACAS to provide mediation at the meeting, but the Company was not willing to accept the cost of appointing the independent chair. After almost two months, during which time Mr Cleaver had not returned to work, had not been paid any wages and had no assurances from the Company, he felt he had no other option but to resign his employment and seek a claim for unfair constructive dismissal. On hearing the Employment Tribunal’s decision, Mr Cleaver said “The actions of the Managing Director and the complete lack by other managers present at the meeting to restrain or rebuke him in any way, left me feeling physically sick and shaking. There is no way that I, or any other employee, should be expected to put up with behaviour that amounts to bullying and harassment from anyone, let alone the Managing Director. It has been an extremely worrying time for me, having to put myself out of work at my age, but I had no other choice as I had no doubt in my mind that Mr Mitchell intended violence against me. I am extremely grateful to the United Road Transport Union for all their help and assistance in this matter and, in particular, my Regional Officer, Mike Billingham, who pleaded the case, on my behalf, at the Tribunal hearing.” United Road Transport Union Regional Officer, Mike Billingham, said “We are extremely pleased with this outcome. Claims for constructive dismissal are often the most difficult to establish as the incident must be a fundamental breach of the contract, unable to be remedied and the employee must have taken the immediate action of resigning at the time of the breach, with no certainty, whatsoever, of the outcome of any tribunal claim. We are of the opinion that this was far from being an isolated incident and the decision is not only right and proper for Peter but will also be a clear message to other employees at the Company that they do not have to put up with such improper conduct and that their trade union will always stand up against bullies.” A Remedy Hearing has now been arranged for the 21 June, again at the Leicester Employment Tribunal, where the United Road Transport Union will be seeking financial compensation for Mr Cleaver in excess of £18,000. Well here we are 6th February 2011 still up and running UPS (United Parcel Service UK Ltd) and now including new Managers still not prepared to have the truth aired in Open Court to try and shut this site down despite their threats to do just this, I wonder why? They say that they have just had an inquiry into the illegal practices of some of their Managers in the UK, but nothing appears to have changed still Drivers are being disciplined for the consequential actions of some Managers and some Managers are still covering for each other and safeguarding the jobs of each other and their pet Employees. Still they run a pay system contrary to article 10 in the New Drivers Hours Regulations, with no opposition from VOSA or URTU. UPS still say that it is not a road safety issue to pay drivers a bonus to complete excess mileage each day and a bonus to load extra vehicles each day. If this is correct why does article 10 exist? What really happened to all the pallets? 31ST October 2010 Well here we are one year since UPS through their Solicitors threatened to shut this Web Site down but we are still UP and GOING STRONG I see nothing has changed at UPS their Managers (Paul Sellars, Paul Webb, Julian Smith, and Mick Labourn) are still telling Drivers to falsify Tacoghraph records in so much that they tell Drivers to record Periods of availability which they the Drivers do not know about in advance, and every time a vehicle stops at traffic lights or road works ect it is recorded as a period of availability on their Tacoghraph’s, they are telling Drivers to start before 0400 hrs and be prepared to be at work in excess of ten hours, when the legal limit for night work (Drivers) is ten hours total work including driving. They are telling Drivers to be at their work stations in excess of 17 hours a day and count it as ten hours or less to make it look on paper that UPS is complying with the 48 Hour Working time Directive. They do this by only recording Driving as work and all other time as Periods of Availability but the Drivers have still been on duty for at least 17 hours. Is it Legal? Is it safe? I think not!!! But UPS Managers are a law unto themselves .UPS in their Code of Business Practice (http://www.ups.com/content/corp/code_conduct.html) Preach a sensible and legal approach but in practice do the exact opposite. Not one single Driver at UPS Shaw Cross / Derby knows the name of The Nominated Transport Manager or how to contact this person (not really an open door?) Where are all the White Pallets? Who recieved the big brown envelopes stuffed with cash?
